Terms of Use

Last updated: July 12, 2026

This translation is provided for convenience. If there is any difference, the French version prevails.

These Terms of Use (the "Terms") govern access to and use of the Contact mobile app (the "App").

By creating an account, accessing the App, or using all or part of the service, you acknowledge that you have read, understood, and accepted these Terms.

01

The App is published by:

The publisher can be contacted with any question relating to the use of the App, your user account, these Terms, a report, a complaint, or personal data.

02

Description of the service

Contact is a proximity-based social app that allows users to discover people around them, connect, exchange messages, and take part in or propose real-life activities.

The service relies in particular on geographic proximity, actual or likely crossings, interests, wishes, activities, connections, and interactions between users.

Some features require access to your location. Without location permission, all or part of the service may be unavailable, limited, or degraded.

The App is not a service for emergencies, personal safety, monitoring, identity verification, or guaranteed meetings.

The publisher does not guarantee that using the App will bring you meetings, connections, messages, invitations, activities, or any particular results.

03

Conditions for accessing the service

Use of the App is restricted to people who are at least 18 years old.

By creating an account, you represent that you are at least 18 years old and that you have the legal capacity necessary to accept these Terms.

You agree to provide accurate, truthful, and up-to-date information when you create your account and for as long as you use the service.

Each user may create and use only one personal account. Creating multiple accounts, fake accounts, automated accounts, or accounts intended to deceive other users is prohibited.

The publisher reserves the right to refuse access, or to suspend, limit, or delete an account, in the event of a violation of these Terms, abusive behavior, misrepresentation of age, fraud, attempted circumvention, or a risk to the safety of other users.

04

Account creation, management, and deletion

You can create an account using the methods offered in the App, including an email address, an Apple account, a Google account, or any other authentication method offered.

You are responsible for keeping your login credentials confidential and for any activity carried out through your account.

You must notify the publisher immediately in the event of any unauthorized use of your account or if you suspect that it has been compromised.

You can request the deletion of your account from within the App or by contacting the publisher at privacy@contactnearby.app.

Account deletion results in the deactivation of the account and the erasure or anonymization of the associated personal data within a maximum of 30 days, except where retention is required by law or is necessary for security purposes, fraud prevention, the handling of a dispute, or the processing of a report, or where a temporary technical constraint applies.

Some temporary technical backups may remain for a limited period, in particular as part of the service's automatic backups. These backups are not used to actively provide the service and are overwritten according to the applicable technical cycle.

After your account is deleted, you lose access to your messages, connections, activities, settings, subscriptions linked to the App, and other data associated with the service, subject to the app stores' own rules regarding subscriptions.

Deleting your Contact account does not automatically cancel a subscription purchased through Apple's App Store or Google Play. You must cancel your subscription separately from your Apple or Google account.

05

Subscriptions, paid features, and advertising

The App may offer free and paid plans.

The offers may include, in particular:

  • Contact Sans Pub (ad-free plan);
  • Contact Plus;
  • Contact Max;
  • any other plan, launch offer, or temporary benefit offered in the App.

The features, limits, prices, benefits, and conditions of each plan are displayed directly in the App at the time of purchase or subscription.

On iOS, subscriptions and in-app purchases are bought through Apple's App Store. Payment, automatic renewal, cancellation, and any refunds are handled by Apple in accordance with the terms applicable to your Apple ID.

On Android, if the App is available on Google Play, subscriptions and in-app purchases are bought through Google Play. Payment, automatic renewal, cancellation, and any refunds are handled by Google in accordance with the terms applicable to your Google account.

The subscription renews automatically each period unless you cancel it before the renewal date.

You can manage or cancel your subscription from your Apple or Google account settings.

The publisher does not directly collect your full payment card details when payments are handled by Apple, Google, or a third-party payment provider.

Access to paid features may be suspended, limited, or lost in the event of expiration, cancellation, a refund, payment failure, detected fraud, or a violation of these Terms.

The App may offer a free version funded in part by advertising. If ads or tracking technologies are used, the relevant information is detailed in the Privacy Policy and in the applicable settings or permission requests.

06

Rules of conduct

You agree to use the App in a respectful, honest, and careful manner and in compliance with the law.

The following, in particular, are prohibited:

  • harassment, threats, intimidation, or overly insistent behavior;
  • hateful, discriminatory, violent, or humiliating remarks, or remarks inciting hatred;
  • illegal, dangerous, fraudulent, or misleading content, or content that harms others;
  • explicit nudity, sexually explicit content, or content intended to shock;
  • content involving minors inappropriately;
  • impersonation;
  • the use of photos belonging to others without permission;
  • the posting of a third party's personal information without their consent;
  • spam, unauthorized commercial solicitation, fake profiles, or abusive automation;
  • unauthorized commercial, promotional, or professional accounts;
  • the mass collection, extraction, or reuse of other users' data;
  • any attempt to circumvent limitations, subscriptions, security rules, technical restrictions, or moderation systems;
  • the use of the App to monitor, track, locate, or harass someone;
  • any behavior that could undermine the safety, peace of mind, or rights of other users.

The publisher may publish additional community guidelines. These guidelines form an integral part of these Terms when they are made available in the App or on the website.

07

Reporting, blocking, and moderation

The App may allow users to block or report other users, content, profiles, messages, activities, or behavior.

The publisher may review reports and take any action it deems necessary, including:

  • a warning;
  • removal or hiding of content;
  • limitation of certain features;
  • temporary suspension of the account;
  • a permanent ban;
  • temporary retention of certain information necessary for security, evidentiary purposes, the prevention of abuse, or the handling of a dispute.

The publisher is not required to continuously monitor all content posted or exchanged by users but may take action when content or behavior is reported to it, detected, or brought to its attention.

You understand that blocking another user may prevent or limit certain interactions but does not guarantee that crossing paths outside the App, in any form, will be impossible.

08

Content posted by users

You retain ownership of the photos, text, messages, descriptions, wishes, activities, and other content that you post or transmit through the App.

By posting content in the App, you grant the publisher a non-exclusive, worldwide, royalty-free license, transferable to the necessary technical service providers and limited to the operation of the service. In particular, this license makes it possible to host, store, display, transmit, technically adapt, back up, moderate, and secure the content.

This license is granted solely to provide, operate, secure, moderate, improve, and maintain the App.

You warrant that you hold all the necessary rights to the content you post, including your photos, text, personal information, images, and protected materials.

You agree not to post any content that violates the rights of others, privacy, image rights, intellectual property, public order, or the law.

The publisher may remove, hide, or limit access to any content that is contrary to these Terms, the community guidelines, the law, or the safety of users.

09

Geolocation

Location is an important feature of Contact. In particular, it makes it possible to display nearby profiles, detect certain crossings, suggest relevant activities, and improve the user experience.

Depending on the permissions you grant, the App may collect and process location data while the App is in use. A broader location permission, for example "Always" or its equivalent depending on the operating system, may be offered for certain advanced features. This permission remains optional and can be controlled from your phone's settings.

You can change or withdraw your location permissions at any time in your device settings.

If you refuse or withdraw location access, certain proximity features may be limited, unavailable, or less relevant.

The App may offer additional controls, such as pausing your visibility, Incognito mode, exclusion zones, or precision-related settings. The exact availability of these controls may change.

You agree not to use the proximity features to monitor, track, locate, harass, or endanger another person.

The conditions under which location data is collected, retained, and used are detailed in the Privacy Policy.

10

Safety during in-person meetings

Contact facilitates discovery, exchanges, and the organization of real-life moments between users. The publisher does not guarantee the identity, intentions, availability, behavior, reliability, or sincerity of users.

You are solely responsible for your exchanges, your decisions to meet, your travel, and your behavior during in-person meetings.

It is recommended that you:

  • favor public places for a first meeting;
  • tell a friend or family member if you are meeting someone you do not know;
  • avoid sharing sensitive personal information too quickly;
  • avoid sending money or personal documents to someone you do not know;
  • report any suspicious, aggressive, overly insistent, or inappropriate behavior;
  • leave an uncomfortable or dangerous situation immediately;
  • contact the relevant authorities in the event of immediate danger.

The App is not a substitute for your own vigilance.

11

Availability, changes, and liability of the service

The App is provided "as is" and subject to availability.

The publisher uses its best efforts to ensure that the service operates properly but does not guarantee continuous, uninterrupted, error-free, or bug-free access, or access without any temporary loss of features.

The service may be interrupted, limited, suspended, or modified for reasons of maintenance, security, technical changes, force majeure, network problems, an app store decision, legal constraints, or any other legitimate reason.

The publisher does not guarantee any particular result, including with respect to meetings, connections, messages, activities, visibility, compatibility between users, or the growth of your social network.

The publisher cannot be held liable in the event of:

  • misuse of the service;
  • the behavior of another user;
  • an in-person meeting;
  • content posted by a user;
  • false information provided by a user;
  • indirect loss;
  • damage resulting from an event beyond the publisher's reasonable control;
  • temporary unavailability of the service;
  • restrictions imposed by Apple, Google, a network operator, a technical service provider, or a competent authority.

No provision of these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

12

Intellectual property

The App, its name, interface, features, databases, text, graphic elements, code, logo, and distinctive elements are protected by intellectual property rights.

Without prior written authorization, you may not:

  • copy, reproduce, distribute, or exploit the App;
  • extract or reuse a substantial part of the data;
  • scrape, index, or harvest profiles;
  • circumvent technical or commercial limitations;
  • engage in reverse engineering, decompilation, or any attempt at unauthorized access;
  • use the App's name, logo, or visual elements for commercial, fraudulent, or misleading purposes;
  • create a competing service by improperly using the App's data, interfaces, content, or features.

13

Personal data

Using the App involves the collection and processing of personal data, including certain profile, identification, location, usage, messaging, photo, reporting, notification, and subscription data.

This processing is described in detail in the Privacy Policy, which is accessible from the App and from the website or the App's product page.

You have rights over your personal data, including the rights of access, rectification, objection, erasure, restriction, and portability, as provided for by applicable regulations.

For any request relating to personal data, you can contact the publisher at the following address: privacy@contactnearby.app.

The publisher may request additional information to verify the identity of the person making the request when this is necessary to protect personal data.

14

Third-party services and app stores

The App may rely on third-party services necessary for its operation, including hosting, authentication, mapping, notification, payment, app store distribution, crash reporting, or technical measurement services.

Use of the App may also be subject to the terms of the Apple App Store, Google Play, or other distribution platforms.

The publisher is not responsible for the terms, decisions, interruptions, refusals, refunds, or restrictions imposed by these platforms or third-party services, unless otherwise required by law.

15

Changes to the Terms of Use

The publisher may amend these Terms to take into account changes in the service, regulations, features, subscriptions, security rules, or app store requirements.

In the event of a material change, you may be informed by any appropriate means, including in the App, by email, or the next time you log in.

The applicable version is the one in effect at the time you use the App.

If you reject the new Terms, you must stop using the App and may request the deletion of your account.

16

Termination

You may stop using the App at any time and request the deletion of your account.

The publisher may suspend or terminate your access in the event of a violation of the Terms, dangerous behavior, fraud, abuse, technical circumvention, infringement of the rights of others, misrepresentation, suspicious activity, or a risk to the security of the service or the safety of users.

Deleting your account does not automatically cancel a subscription purchased through the App Store or Google Play. You must cancel your subscription separately from your Apple or Google account.

17

Complaints and consumer mediation

For any complaint, you can contact the publisher at the following address: support@contactnearby.app.

You are encouraged to first send a written complaint to the publisher in order to seek an amicable solution.

If the dispute persists and you are acting as a consumer, you may refer the matter to a consumer mediator free of charge, under the conditions set out in the French Consumer Code.

The designated consumer mediator, its address, and its website will be indicated before a paid service is actually made available to the general public, if this information is not already available in the App or in the applicable contractual documents.

18

Governing law and jurisdiction

These Terms are governed by French law.

In the event of a dispute, the parties will first endeavor to seek an amicable solution.

Failing an amicable resolution or mediation, the competent courts will be determined in accordance with the applicable rules of procedure.
